Did You Receive UI Benefits in 2009?
Reporting Your Tax Information to the IRS

The Texas Workforce Commission (TWC) mails Internal Revenue Service (IRS) Form 1099-G to all Unemployment Insurance (UI) claimants who were paid benefits in 2009. TWC will mail 1099-G forms from January 8, 2010, through January 22, 2010.

You do not need to attach the paper 1099-G form to file your federal income tax return. Simply report the amount of UI benefits that TWC paid you on the correct line. Beginning February 1, 2010, you can find the total benefits TWC paid you in 2009 by:

  • Go to Unemployment Benefits Services and select IRS 1099-G Information.
  • Log on using your User ID and Password
  • Select IRS 1099-G Information from the Quick Links menu.

When reporting your UI benefits to the IRS:

  • Enter the amount of benefits you are required to report in Line 19 of IRS Form 1040, or Line 3 of IRS Form 1040EZ. See IRS Instructions, page 27 (PDF).
    • For the 2009 tax year only, you may deduct the first $2,400.00 of UI benefits you received from the amount you report to the IRS.
    • The amount listed on the 1099-G includes any overpaid benefits. TWC must report to IRS the full amount we paid you, even if you repaid benefits. If you repaid some or all of an overpayment in 2009, subtract the amount you paid back from the amount you are required to report. If you repaid an overpayment in a different year, please contact the IRS or your tax professional for assistance.

  • Enter the TWC Federal ID number as 74-2764775.

If you do not receive Form 1099-G by February 1, 2010, TWC may have an incorrect address on file. You can change your address by logging on and selecting Contact Information from the Change My Profile menu, or by calling a TWC Tele-Center. Once you have changed your address, you must request a duplicate Form 1099-G.

If you would like to request a duplicate Form 1099-G, call Tele-Serv and press option 2 or call a TWC Tele-Center. Make sure that TWC has your correct address before you request the duplicate form. Some professional tax preparers may require a paper copy of your 1099-G when completing your tax return.

If you believe that the amount shown on your Form 1099-G is wrong, remember that TWC reports the entire amount we paid you, including overpayments. You can view a history of your 2009 UI benefits payments by selecting Claim and Payment Status and logging on.
