Criminal Prosecutions of Unemployment Insurance Fraud - Recent Dispositions

The Texas Workforce Commission (TWC) refers to District Attorney offices for possible criminal prosecution cases in which TWC has determined that unemployment insurance (UI) benefits were obtained by a claimant through fraud or deception.

* During July/Aug/Sept/Oct/Nov/Dec 2007, i.e., the last 2 quarters of 2007, TWC Learned the Details of the Following Dispositions:

BEXAR COUNTY

  • On 8/27/07, Dora D. New-Smith, 48, received 5 years deferred adjudication probation from the 187th District Court on the charge of state jail felony theft. New-Smith was ordered to make $3,784 restitution, to pay a $500 fine and $293 court costs, and to perform 100 hours community service.
  • On 9/5/07, Willie Medina, 61, received 2 years deferred adjudication probation from the 144th District Court on the charge of state jail felony theft. Medina was ordered to make $3,809 restitution and to pay a $550 fine.
  • On 10/8/07, Steven C. Hudkins, 46, received 3 years deferred adjudication probation from the 399th District Court on the charge of state jail felony theft. Hudkins made $1,000 restitution before sentencing and was ordered to make an additional $2,280 as a condition of probation. Further, Hudkins was ordered to pay a $1,500 fine and $293 court costs, and to perform 200 hours community service.

CASS COUNTY

  • On 9/4/07, Jeremy O. Kyle, 27, was convicted of state jail felony securing execution of document by deception by the 5th District Court and was sentenced to 5 years regular probation. Kyle was ordered to make $3,908 restitution, to pay a $2,000 fine and $687 court costs, and to perform 200 hours community service.

CHAMBERS COUNTY

  • On 11/7/07, Tommy R. King, 37, received 10 years deferred adjudication probation from the 344th District Court on the charge of state jail felony false statement to obtain property or credit. King was ordered to make $3,362 restitution, to pay a $1,500 fine and $227 court costs, and to perform 300 hours community service.

COLLIN COUNTY

  • On 7/6/07, Jacqueline D. Brice, 31, received 1 year deferred adjudication probation from the 416th District Court on the charge of state jail felony theft. Brice was ordered to make $5,276 restitution, to pay a $750 fine, and to perform 120 hours community service.
  • On 8/10/07, Tommy J. Edmonds, 40, was convicted of state jail felony Theft by the 219th District Court and was sentenced to 3 years regular probation. Edmonds was ordered to make $7,389 restitution, to pay a $500 fine and $273 court costs, and to perform 120 hours community service.
  • On 9/27/07, Ferris L. Patterson, 49, received 3 years deferred adjudication probation from the 380th District Court on the charge of state jail felony securing execution of document by deception. DALLAS COUNTY

  • On 6/5/07, Angelo A. Martin, 45, received 3 years deferred adjudication probation from the 203rd District Court on the charge of state jail felony securing execution of document by deception. Martin was ordered to make $5,904 restitution, to pay a $2,000 fine and $198 court costs, and to perform 160 hours community service.

  • On 7/12/07, Antonia C. Cruz, 34, received 3 years deferred adjudication probation from Criminal District Court No. 7 on the charge of state jail felony securing execution of document by deception. Cruz was ordered to make $4,668 restitution and to pay a $1,000 fine.

  • On 7/20/07, Hawanya A. Brent, 34, was convicted by Criminal District Court No. 5 of Class A misdemeanor securing execution of document by deception and sentenced to 1 year regular probation. Brent made $8,200 before sentencing and was ordered to pay a $500 fine and to perform 80 hours community service.

  • On 8/7/07, Jamie H. Armistead, 30, received 2 years deferred adjudication probation from the 248th District Court on the charge of state jail felony theft. Armistead was ordered to make $5,800 restitution ($1,500 of which he paid before sentencing), to pay $203 court costs, and to perform 100 hours community service.
  • On 8/10/07, Kendall J. Lamb, age 41, received 5 years deferred adjudication probation from the 195th District Court on the charge of state jail felony securing execution of document by deception. Lamb was ordered to make $11,152 restitution, to pay a $1,500 fine, and to perform 120 hours community service.
  • On 8/14/07, Michael R. McGee, 35, received 2 years deferred adjudication probation from the 232nd District Court on the charge of Class A misdemeanor theft. McGee was ordered to make $7,165 restitution ($4,000 of which he paid before sentencing) and to pay $151 court costs.

  • On 10/19/07, Kurt W. Gibson, 39, received 4 years deferred adjudication probation from Criminal District Court No. 7 on the charge of state jail felony securing execution of document by deception. Gibson was ordered to make $2,790 restitution.
  • On 10/23/07, Ronald M. Self, Jr., 39, received 5 years deferred adjudication probation from the 283rd District Court on the charge of state jail felony securing execution of document by deception. Self was ordered to make $5,742 restitution, to pay a $1,000 fine and $223 court costs, and to perform 120 hours community service.
  • On 11/2/07, Michael Wilson, 39, received 5 years deferred adjudication probation from the 282nd District Court on the charge of state jail felony securing execution of document by deception. Wilson was ordered to make $15,283 restitution and to pay a $1,500 fine.
  • On 12/6/07, Arthur M. Wright, 34, was convicted of state jail felony securing execution of document by deception by Criminal District Court No. 2 and sentenced to 5 years regular probation. Wright was ordered to make $6,140 restitution, to pay a $1,500 fine, and to perform 250 hours community service. Additionally, Wright was ordered to maintain full time employment as a condition of probation.
  • On 12/6/07, Allen Whitwell, 59, received 5 years deferred adjudication from the 282nd District Court on the charge of state jail felony securing execution of document by deception. Whitwell was ordered to make $5,940 restitution, to pay a $500 fine, and to perform 250 hours community service. Additionally, Whitwell was ordered to maintain full time employment in which he is not to handle money.

  • On 12/13/07, Cindy L. Bowles, 45, received 3 years deferred adjudication probation from Criminal District Court No. 1 on the charge of state jail felony securing execution of document by deception. Bowles was ordered to make $4,320 restitution and to pay a $1,000 fine.
  • On 12/13/07, Travis J. Jackson, 33, was convicted of state jail felony securing execution of document by deception by the 204th District Court and sentenced to 10 months incarceration. Jackson was ordered to make $3,300 restitution and to pay a $300 fine.
  • On 12/14/07, Vickey V. White, 40, was convicted of state jail felony securing execution of document by deception by the 204th District Court and sentenced to 5 years regular probation. White was ordered to make $5,620 restitution and to pay a $1,500 fine.

FANNIN COUNTY

  • On 8/16/07, Richard Allen, 51, received 2 years deferred adjudication probation from the 336th District Court on the charge of state jail felony securing execution of document by deception. Allen made $3,248 restitution before sentencing. He was ordered to pay a $600 fine and $283 court costs, and to perform 150 hours community service.

FORT BEND COUNTY

  • On 9/14/07, Ricky L. Moore, 51, received 1 year deferred adjudication probation from the 268th District Court on the charge of state jail felony theft. Moore was ordered to make $2,640 restitution and to perform 100 hours community service.
  • On 10/12/07, Cassandra L. Dennis, 36, received 2 years deferred adjudication probation from the 400th District Court on the charge of state jail felony theft. Dennis was ordered to make $7,200 restitution, to pay a $500 fine and $248 court costs, and to perform 120 hours community service.
  • On 10/15/07, Michael A. White, 39, received 5 years deferred adjudication probation from the 240th District Court on the charge of state jail felony theft. White was ordered to make $6,384 restitution, to pay a $500 fine and $248 court costs, and to perform 200 hours community service.
  • On 11/9/07, Ricky H. Rodriguez, 45, was convicted of state jail felony theft by the 400th District Court and sentenced to 4 years regular probation. Rodriguez was ordered to make $7,108 restitution, to pay a $500 fine and $240 court costs, and to perform 200 hours community service.

GUADALUPE COUNTY

  • On 10/10/07, Charles W. May, 52, received 2 years deferred adjudication probation from the 25th District Court on the charge of state jail felony theft. May made $4,627 restitution before sentencing and was ordered to pay $263 court costs and to perform 40 hours community service.

HARRIS COUNTY

  • On 6/22/07, Geneva A. Castillo, 38, was convicted by the 176th District Court of state jail felony theft and sentenced to 30 days incarceration. As part of her sentence, Castillo made $4,394 restitution.
  • On 7/26/07, Paul L. Cortez, 42, was convicted of Class A misdemeanor theft by the 230th District Court and sentenced to 30 days incarceration. As part of his sentence, Cortez made $8,489 restitution.
  • On 8/1/07, Ursula L. Thomas, 32, received 2 years deferred adjudication probation from the 184th District Court on the charge of state jail felony theft. Before sentencing, Thomas made $4,260 restitution. Thomas was ordered to perform 40 hours community service, attend an anti-theft course, and pay a $50 crime stopper fee.
  • On 8/28/07, Alexandria Amboree, 30, was convicted of state jail felony theft by the 228th District Court and sentenced to 5 years regular probation. Amboree was ordered to make $4,388 restitution and to pay $281 court costs.

HAYS COUNTY

  • On 8/31/07, Adolph A. Quintero, 33, was convicted of Class A misdemeanor fraudulently obtaining unemployment insurance benefits by County Court at Law No. 2 and sentenced to 2 years regular probation. Quintero was ordered to make $8,896 restitution, to pay a $800 fine and $236 court costs, and to perform 80 hours community service.

HIDALGO COUNTY

  • On 9/5/07, Dionicia Gonzales, 50, was convicted of state jail felony theft by the 370th District Court and sentenced to 5 years regular probation. Gonzales was ordered to make $4,091 restitution, to pay $278 court costs, and to perform 120 hours community service.

HILL COUNTY

  • On 10/8/07, Andrew Martinez, 24, received 5 years deferred adjudication probation from the 66th District Court on the charge of state jail felony securing execution of document by deception. Martinez was ordered to make $4,914 restitution, to pay $268 court costs, and to perform 120 hours community service.

JASPER COUNTY

  • On 7/5/07, Lewis D. Williams, 45, received 2 years deferred adjudication probation from District Court 1A on the charge of state jail felony securing execution of document by deception. Williams was ordered to make $3,735 restitution, to pay a $200 fine, and to perform 120 hours community service.

JEFFERSON COUNTY

  • On 10/1/07, Melvin R. Keller, 35, received 3 years deferred adjudication probation from the 252nd District Court on the charge of state jail felony securing execution of document by deception. Keller was ordered to make $5,056 restitution and to perform 400 hours community service.

LUBBOCK COUNTY

  • On 9/11/07, David Rocha, 38, received 3 years deferred adjudication probation from the 137th District Court on the charge of state jail felony theft. Rocha was ordered to make $4,586 restitution and to perform 400 hours community service.

TRAVIS COUNTY

  • On 8/16/07, Gerard L. Nevit, 52, received 2 years deferred adjudication probation from the 390th District Court on the charge of state jail felony securing execution of document by deception. Nevit made $5,104 restitution before sentencing. He was ordered to perform 120 hours community service.

WHARTON COUNTY

  • On 11/16/07, Gregory Lewis, 49, was convicted of state jail felony theft by the 329th District Court and sentenced to 60 days incarceration. Additionally, Lewis was ordered to make $2,275 restitution and to pay $197 court costs.

WILLIAMSON COUNTY

  • On 10/30/07, Robert J. Azevedo II, 47, received 5 years deferred adjudication probation from the 26th District Court on the charge of state jail felony theft. As a condition of probation, Azevedo was ordered to serve 30 days jail time. Further, Azevedo was ordered to make $6,270 restitution and to pay a $2,500 fine.

  • On 7/30/07, David Flores, 30, received 2 years deferred adjudication probation from the 186th District Court on the charge of state jail felony theft. Flores was ordered to make $3,394 restitution, to pay a $400 fine and $293 court costs, and to perform 120 hours community service.
  • On 12/13/07, Bill Lee, 41, received 2 years deferred adjudication probation in the 227th District Court on the charge of state jail felony theft. Lee was ordered to make $5,871 restitution, to pay a $1,000 fine and $293 court costs, and to perform 100 hours community service.

CAMERON COUNTY

  • On 2/7/08, Hilaria T. Foster, 54, received 5 years deferred adjudication probation from the 138th District Court on the charge of state jail felony securing execution of document by deception. Foster was ordered to make $3,048 restitution.

COLLIN COUNTY

  • On 1/31/08, Roschonda R. King, 27, received 2 years deferred adjudication probation from the 366th District Court on the charge of state jail felony theft. King was ordered to make $5,299 restitution, and to pay a $100 fine, $287 court costs, and a $50 crime stoppers fee.

DALLAS COUNTY

  • On 2/6/07, Tara Jackson, 34, received 2 years deferred adjudication probation from the 194th District Court on the charge of state jail felony securing execution of document by deception. Jackson was ordered to make $3,812 restitution and to pay a $1,500 fine.
  • On 6/19/07, Curtis E. Crow, 38, received 1 year deferred adjudication probation from Criminal District Court No. 3 on the charge of Class A misdemeanor securing execution of document by deception.
