6.12     Requesting Help from another State

Many entities from other states conduct business in Texas and do not always respond to our phone inquiries or correspondence. The result is a request from our Agency to that state for assistance in contacting the entity.

This procedure is not to be used for requesting assistance for Appeals Decisions. Out-of-State agency requests will be sent only when management or another department requests it.

6.12.1     Out-of-State Procedures

Before requesting out-of-state assistance, exhaust all efforts to contact the entity. Not all states have the resources to respond to out-of-state requests. Because of this, requests to another state are usually limited to requests for Status Reports on pending or newly liable accounts. We normally do not request Status Reports for reopens, officer updates etc.

Before requesting assistance from another agency:

  1. Attempt to contact the entity by phone or e-mail if available. Ask to speak with the owner, partner, officer or the entity that has a written authorization (C-42) on file.

  2. Attempt to contact by correspondence. If there is no response to the first request, a second request should be sent (certified mail is no longer used).

6.12.2     Request to Out-of-State Agency

After all efforts have been exhausted:

  1. Prepare the appropriate form letter from 2008 PC letter requesting out-of-state agency assistance. There are three form letters.
  1. Mail the request letter with all available information and forms to the out-of-state agency.  Locate addresses at  http://workforcesecurity.doleta.gov/unemploy/agencies.asp.

  2. Do not trace the account.

  3. Document FTC to show that the request for assistance has been sent. Make a copy of the letter and put it in the Doc Log & Destroy basket.
